Terms and Conditions Mr. Monroe

These terms and conditions apply to every offer made by Mr. Monroe and to every agreement concluded between Mr. Monroe and you as a customer. By placing an order on our website, you agree to these terms and conditions.

1. Who we are

2. Applicability
These terms and conditions apply to every offer made by Mr. Monroe and to every agreement concluded between Mr. Monroe and you as a customer through our online shop.

Before the agreement is concluded, the text of these terms and conditions will be made available to you. If this is not reasonably possible, we will let you know where the terms and conditions can be consulted electronically.

3. The offer
If an offer is valid for a limited period or is subject to conditions, this will be stated explicitly in the offer. The offer contains a complete and accurate description of the products offered, so that you can properly assess the offer.

Obvious mistakes or errors in the offer, such as a clearly incorrect price, are not binding on Mr. Monroe.

4. The agreement
The agreement is concluded at the moment you accept the offer and meet the conditions set out in it. If you have accepted the offer electronically, we will confirm receipt of your acceptance electronically without delay.

5. Prices
All prices on our website are stated in euros and include VAT, unless stated otherwise. Shipping costs are not included in the product price and are shown separately during the ordering process.

Mr. Monroe reserves the right to change prices. For an order you have already placed, the price applicable at that time will continue to apply.

6. Payment
Payment is made using the payment methods offered during the ordering process. Your order will be processed as soon as we have received and confirmed payment.

7. Delivery and performance
Mr. Monroe will take the greatest possible care in receiving and carrying out orders. The place of delivery is the address you have provided to Mr. Monroe.

For shipping costs, delivery times and international shipping, please refer to our separate shipping policy, which forms part of these terms and conditions.

The risk of damage to and/or loss of products remains with Mr. Monroe until the moment of delivery, unless expressly agreed otherwise.

8. Right of withdrawal
As a consumer, you may cancel (withdraw from) your purchase within 14 days of receipt. Let us know within that period at cheers@mrmonroe.com. You can use the model withdrawal form at the bottom of these terms and conditions, but you do not have to.

The right of withdrawal does not apply to food products, such as coffee, whose seal has been broken after delivery.

Please return the product within 14 days of notifying us. Return shipping costs are for your account. Do not unpack or use the product more than necessary to assess it.

We will refund the purchase price and the standard shipping costs within 30 days of your notification. We may wait until we have received the product or until you have sent us proof of shipment.

9. Damaged or incorrect products
Our products must be as described and in good condition. Has a product arrived damaged, have you received the wrong item, or is something else not right? Please email us as soon as possible at cheers@mrmonroe.com with your order number and photos of the problem. We will send you a replacement or refund you. In most cases, you do not need to send the product back.

10. Complaints procedure
You can report complaints about the performance of the agreement to cheers@mrmonroe.com. We aim to respond to complaints within 14 days. If a complaint requires a longer processing time, you will receive an indication within that period of when you can expect a more detailed response.

11. Liability
Mr. Monroe is not liable for damage resulting from incorrect or careless use of our products, or for damage caused by you providing an incorrect shipping address. To the extent permitted by law, our liability is limited to the amount covered by our insurance or, if there is no insurance cover, to the invoice amount of the order concerned.

Nothing in these terms and conditions limits liability for intent or deliberate recklessness, or to the extent that this is not permitted under mandatory Dutch law.

12. Force majeure
Mr. Monroe is not obliged to fulfil any obligation if it is prevented from doing so as a result of force majeure, such as (but not limited to) delays at suppliers or carriers, strikes, or other circumstances beyond our reasonable control.

13. Intellectual property
All intellectual property rights to the content of our website, including texts, images, logos and the name Mr. Monroe, belong to Mr. Monroe or its licensors. None of this content may be reproduced or made public without prior written permission.

14. Applicable law and disputes
Agreements between Mr. Monroe and you as a customer are governed by Dutch law. If you live in another country, you retain the protection afforded to you by the mandatory law of that country.

Disputes that cannot be resolved by mutual agreement may be submitted to the competent court in the Netherlands or in the country where you live.

15. Changes
Mr. Monroe may amend these terms and conditions from time to time. The most recent version can always be consulted on our website. Changes do not apply to orders you placed before the change.

16. Subscriptions
With a subscription, we deliver your coffee periodically, at the frequency and price you choose when you sign up. The subscription runs for an indefinite period.

You can cancel your subscription at any time through your account or by email to cheers@mrmonroe.com. A notice period of one month applies. Deliveries that are already being processed will still be sent to you.

If we change the price, we will notify you at least one month in advance. You may then cancel free of charge before the new price takes effect.
